TERMS AND CONDITIONS OF USE OF WEBSITE

ACCEPTANCE OF TERMS AND CONDITIONS AND OTHER IMPORTANT LEGAL MATTERS

The Never Say I Know Partnership, together with, where the context permits, each and all of its partners for the time being, will be referred to both as “NSIK” and as "we", "our" and so on, throughout these terms and conditions.

This page tells you the terms and conditions subject to which you may make use of this website www.alex-knight.com (the “Website”).

By using the Website, you accept these terms agree to abide by them. If you do not agree to these terms of use, please do not use it. We may amend these terms and conditions at any time by amending this page. You should therefore check this page before using the Website, as any changes we may make will be binding on you.

You may request us to supply goods by ordering them but we will not be obliged to accept or meet any such order.

Nothing on the Website constitutes advice about, or a recommendation as to, any course of action or product. NSIK and each and all of its partners excludes any and all liability for loss or damage arising from reliance on any representation or statement on the Website.

VARIATIONS, AVAILABILITY, ACCURACY

We aim to update the Website regularly, and may change the content at any time. If the need arises, we may suspend access to the Website, or close it indefinitely. Whilst we intend to keep the material on the Website accurate, complete and up to date, we are under no obligation to do so and NSIK, and each and all of its partners, exclude any and all liability in relation to these matters.

DISCLAIMER AND EXCLUSION OF LIABILITY

Whilst we of course intend to keep the Website secure and protect it from viruses, neither NSIK nor any of its partners will be liable for any errors or omissions within it; or for any loss or damage caused by a distributed denial-of-service attack, or viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or your downloading of any material posted on it, or any website linked to it.

To the fullest extent permitted by law, we, and each of our partners individually, exclude, in relation to any and all aspects of the Website, its maintenance, use and any and all other matters in any way connected with it and/or any website connected to it:

  • All conditions, warranties and other terms which might otherwise be implied or introduced by statute, common law or the law of equity; and
  • Any and all liability for any direct, indirect or consequential loss or damage incurred by any user or third party in connection with the Website or its use, any websites linked to it and any materials posted on it, including, without limitation, any liability for loss of income or revenue; for failure of, or harm to, any system and/or for loss of business, profits or goodwill.

NSIK PRIVACY POLICY

The privacy and security of your information is extremely important to us.

The policy explains how we use the information we collect about you and the procedures that we have in place to safeguard your privacy while you use our website.

Your information and how we use it

We will use the information that we collect about you only in accordance with the law, including all the requirements of the Data Protection Act 1998. In particular, we will use your information to process orders and send communications, for example our newsletter, to you.

When you place an order with NSIK we need to know your name, delivery address, credit or debit card number and expiry date, email address and telephone number. This information allows us to fulfil your order and notify you of the status of your order.

If you subscribe to our mailing lists for pre-orders, our newsletter and other information, you may be asked to specify the areas in which you are involved so that we can tailor the information which we send to you to cover topics which we believe you might be interested in.

We monitor customer traffic on an aggregate basis in order to help us develop and improve our website for the benefit of our customers.

By submitting your information you consent to the use of that information as set out in this Privacy Policy. If we change our Privacy Policy we will post the changes on this page so that you may be aware of them. Because the Internet infrastructure is global, and it is not possible to predict the routes that information sent over the Internet will take, the information you provide may be transferred temporarily via a route which takes it outside the European Economic Area as it passes between you and us. By submitting your information you consent to this transfer.

Opt in/opt out

If you have opted to receive notifications from us and wish to stop receiving such notifications you may remove your preferences by clicking the unsubscribe link at the bottom of your emails and following the instructions provided.

Cookies

Our site uses cookies to keep track of your visits to our website. A cookie is a small file that can be stored by your browser on your computer’s hard drive. You can usually change your browser so that it will not accept cookies.

The precautions we take

All personal information stored by us is kept on a server in a secure environment.

We do not store credit card details nor do we share customer details with any third parties. Credit card transactions are processed via our contracted third party service provider, PayPal.

These precautions reflect the seriousness with which we take your information’s privacy and security.

However, the Internet is, of course, not a 100% secure medium for communication. We therefore cannot guarantee the security of any information you send to us (or we send to you) via the Internet. Therefore neither the Never Say I Know Partnership, nor any of its partners individually, can be responsible for any loss or damage which you, or others, may suffer as a result of the loss of confidentiality of such information; and all partners, both collectively and individually, exclude any and all such liability.

INTELLECTUAL PROPERTY RIGHTS

NSIK is the owner or licensee of all actual and potential intellectual property rights in the material on, or used in operating, the Website (and, for the avoidance of doubt, in all relevant software, operating systems, marks and text) (collectively, the "Rights and Materials"). We may seek to register, patent or take any other protective action in relation to the Rights and Materials or any part of them; and we reserve all our rights in this connection.

You must not without our written permission use, copy, reproduce, modify, distribute, republish, display, post or transmit any, or any part of the, Rights and Materials; and you must do nothing which you believe, know, or ought reasonably to know, might prejudice our interest in the Rights and Materials or reduce their value to us.

VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse the Website by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer or database connected to it, or attack it via a denial-of-service attack or a distributed denial-of-service attack. To do so would be a criminal offence under the Computer Misuse Act 1990. If you do any of the foregoing your access to the Website will be terminated immediately.

LINKS

You must not link to the Website in any way that suggests any form of association, approval or endorsement on our part.

Where the Website contains links to other sites and resources provided by third parties, these links are provided for your convenience only.

We have not reviewed these third party websites and we have no control over their contents. We do not endorse or make any representations about them, or any services, products or materials found in them, or that may be available through them, or any results that may be obtained from using them. Neither NSIK nor any of its partners can accept any responsibility for them; and NSIK and each and all of its partners exclude any and all liability for any loss or damage that may arise from your use of them.

CUMULATIVE NATURE OF OUR RIGHTS AND EXCLUSIONS

Our rights and powers, and any and all exclusions and limitations of any obligation to which we may be subject, will be cumulative, and will supplement but not derogate from each other. If any such provision shall be found to be void or unenforceable, it will not prejudice the enforceability of any other; and will itself be replaced by an enforceable provision which as nearly as possible gives effect to its intention.

In the event of any conflict between any of the provisions of these terms and conditions, we will choose which is to prevail.

INTERPRETATION, APPLICABLE LAW AND JURISDICTION

The cross-headings in these terms and conditions are not relevant to their interpretation.

These terms and conditions are governed by, and will be construed according to, English law; and any dispute relating to them or to the Website will be determined according to English Law, and will be subject to the exclusive jurisdiction of the English Courts.
